Yesterday I sent a friendly email to Hagens Berman, (the firm that won the settlement) with this question:

Performance, fuel economy and drivability have suffered since the AEM Update. The AEM Disclosure specifically states that these things were not expected to change. Is this legally binding?

Also mentioned the upcoming recall for EGR failures.
